Federal Circuit May Be in for Big Changes

Two-thirds of the members of the “youngest” of the federal appellate courts, the Federal Circuit, will qualify for retirement or senior status in the next two years, presenting a rare opportunity for the next president to shape that court. Federal courts scholar Arthur D. Hellman notes that Federal Circuit appointments have generally not been as politicized, “but the stakes now are very high, given the current controversy over patent reform legislation — a very high-stakes legislative issue.”
